Tiktok content creator Kelley Heyer demanded the Roblox video game for using it Dance to “Apple” by Charli XCX Without permission.

Heyer published the viral dance in June 2024, which fed from the exit of the successful summer album of Charli XCX “Brat.” The dance became so popular that Charli XCX incorporated him into his live show and even invited Heyer to interpret the dance in his show in New York City.

Fortnite and Roblox, two popular successful games among the children, each incorporated the dance in their games, which allowed the players to buy “emotages” of the dance to act their avatars. But while Fortnite obtained Heyer’s permission to license his choreography, he alleges Roblox did not sign an agreement To do so.

“Roblox advanced using Kelley’s IP without a signed agreement. Kelley is an independent creator who should be fairly compensated for his work and we didn’t see another option to file a lawsuit to prove it,” said Miki Anzai, Heyer’s lawyer. “We remain willing and open to resolve and hope to reach a peaceful agreement.”

According PolygonHeyer estimates that Roblox won more than $ 123,000 by selling more than 60,000 “Apple” dance emotots.

“As a platform promoted by a community of creators, Roblox takes very seriously the protection of intellectual property and undertakes to protect the intellectual property rights of developers and independent creators to brands and artists both inside and outside the platform,” Roblox said in a statement.
