New Civil Liberties Alliance, a conservative legal group, filed a lawsuit against the Trump administration for imposing tariffs on Chinese imports.
Presented in a federal court in Florida, the lawsuit alleges that Trump lacked the legal authority to impose the radical tariffs presented on Wednesday, as well as the duties authorized on February 1 under the International Law of Emergency Economic Powers (IEEPA).

“In his almost 50 years of history, no other president, including President Trump in his first term, has tried to use IEEPA to impose tariffs,” said Nucla.

The senior litigation lawyer of the NCLA, Andrew Morris, argued that Trump, imposing heavy tariffs on Chinese imports, had “used” emergency powers “, usurped the right of Congress to control tariffs and alter the separation of powers from the Constitution.”
NCLA filed the demand on behalf of Simplified, a retailer of Florida home management products.
Trump announced on Wednesday that China would be beaten with a 34%tariff, in addition to the 20%imposed at the beginning of this year, which carries the total of new levies to 54%.

The lawsuit says that presidents can only impose tariffs with the permission of the Congress and under complex commercial statutes that explain how and when they can be authorized.
“These statutes require early investigations, detailed findings and a close adjustment between the legal authority and the scope of a tariff,” says the demand.
Trump has declared an emergency for China’s alleged complicity in the United States opioid epidemic, framing tariffs as a negotiation tool to end the influx of mortal drugs.

Nucla said his demand “does not obstruct” with the Trump statement of an emergency related to opioids, “but it is needed in problems with his decision to impose tariffs in response, without legal authority to do so.”
The case was assigned to the American district judge Kent Wetherell, a Trump designated one who had stopped a key part of the immigration policy of former President Joe Biden in 2023.
